Absent an agreement by the parties, a judge has broad discretion in awarding maintenance, and need only determine that (1) a spouse lacks sufficient resources to provide for his or her reasonable needs, (2)a spouse is unable to become self-supporting or (3) a spouse must care for a child whose needs dictate that the parent delay employment.
Maintenance awards vary greatly. A recent panel of judges who were all given the same case facts were asked to determine the support award amount. They each reached a different conclusion - one awarding $0, the next awarding $1,000 and the final judge awarding $1,500.
For families that have a combined income under $75,000, a specific formula is used to determine maintenance for the lower-earning spouse. However, it is important to remember that judges can always deviate from any guidelines as long as they can legally justify their decisions.

Since there is such a discrepancy in maintenance awards, including the length of time they are in force, it may be wise to agree to an amount and duration of support. Spousal support agreements made between the parties cannot be modified by the court. Some of the considerations that determine a fair spousal support agreement include:
- Reasonable needs of the spouse
- Duration of the marriage
- Work history
- Education level
- Standard of living during the marriage
