Rosie O’Donnell utilizes prenup like other same-sex couples

Popular comedian and former host of “The View” Rosie O’Donnell left the show following announcements that she and her wife had decided to call it quits. Although this is the second divorce for O’Donnell, she reported that she felt quitting the show due to her most recent split was necessary to allow her to focus more on her family. As many other same-sex couples in Colorado do, O’Donnell and her wife had a prenuptial agreement.

According to a representative for O’Donnell, she and her wife — Michelle Rounds — initially split up in Nov. 2014, although neither party actually filed for divorce until March 2015. They originally started dating back in 2011 and were married the following year. By 2013, they welcomed a daughter into their lives through adoption. 

Between the two women, they have five children, including their adopted baby girl. Reports have surfaced that Rounds and O’Donnell are currently sharing custody of their daughter, although it’s unclear if they have a court-approved custody agreement yet. The other four children — all teenagers — are from O’Donnell’s first marriage.

As O’Donnell has already cited the importance of being available for her children through this process, it is likely that determining the most beneficial child custody agreement with her daughter’s best interest in mind will be important to her. Although she and Rounds did have a prenuptial agreement, prenups typically don’t dictate child custody or parenting time since the best interests of the child trumps all in determining these important issues. However, the agreement may have laid out the terms for other issues that other Colorado same-sex couples encounter during divorce, including property division and spousal maintenance.
