Littleton Separate Property Lawyers
People who delay marriage until their 30s or 40s often enter marriage with significant assets that they have accumulated over the years. The same is true of those individuals who remarry.
Many people are unaware that in certain circumstances, the property they brought to the marriage may be deemed separate property in a divorce action. At Jolein A. Harro, P.C., we have more than 25 years serving the Littleton, Colorado, in divorce and property division proceedings.
Denver Premarital And Separate Property Attorneys
Our lawyers at Jolein A. Harro, P.C., want to ensure that after your marriage ends, you have a fair and equitable property settlement – securing you a prosperous and fruitful future. When we handle a divorce, we assure our clients of a thorough review of all property – including ascertaining property that is separately theirs, regardless of the marital estate.
Yours, Mine And Ours
Some clear examples of separate property are inheritances or bequests that you have received. These belong solely to you. The appreciation on these assets, however, is marital property.
For example, if you received $20,000 from a grandparent’s estate, that money is nonmarital; but any interest or gain in its value during the marriage is marital and must be divided with your ex-spouse.
Property division can be further confused when separate property has been co-mingled with marital property. For example, if you use a bank account that you established before the marriage, any balance in it belongs to you – unless, during the marriage, you added funds from the marital estate (for example, depositing a paycheck in it). In that situation, that account becomes marital.
Confusing? Yes! That is why the exceptional, astute and dedicated legal representation of Jolein A. Harro, P.C., is imperative.
