Parent Relocation

A court will consider all information when determining whether to allow a child to relocate with the custodial parent – factors such as whether visitation will be a financial burden to the noncustodial parent, the emotional needs of the child and his or her connection to nearby family, age of the child, and school attendance can all affect a court’s determination regarding relocation.

As in the original custody determination, the court will always default to the best interests of the child. A judge will consider the reason for relocation – for example, a new job or a new marriage – and make a decision based on all available evidence.

It is important to remember that you cannot move a child away from a noncustodial parent without permission from the noncustodial parent or a court order.
