Civil Unions & Cohabitation Agreements

As of May 1st, 2013, the Colorado Civil Union Act went into effect. The Act recognizes unions between couples of the same gender, allowing them all benefits the state of Colorado affords married couples.

The law allows for possible future changes to the Colorado tax code, which would grant couples in a civil union the same tax benefits as married couples. Same-sex couples who are married in other jurisdictions would be recognized in the state of Colorado as having a civil union.

Couples who are planning a civil union should consider preparing a pre-commitment agreement that would serve the place of a premarital or post marital agreement. This allows them to designate property division and other decisions in the event that they terminate their union.

Many couples living together are unaware that they can plan for any eventuality that may occur in their relationship. Just as a marriage license confers certain benefits, a cohabitation agreement can provide stipulations in the event the relationship ends.

For example, if you buy a house or car together, a cohabitation agreement will delineate who will receive the property. Such an agreement can also determine who receives any separate assets that may have been co-mingled with joint funds.

In essence, a cohabitation agreement takes the place of a marital agreement. The agreement is enforceable in court and therefore offers protection for each member of the relationship.
